Shopping Cart Orders
By placing an order with us, you confirm that you have read, understood, and agree to these Terms of Service, and that you agree to be bound by them. If you do not agree to be bound by all of these Terms, please do not place orders using our website. If you are a consumer, you may only purchase products from the website if you are aged 18 years or over. If you wish to purchase products acting on behalf of a business, agreeing to the Terms of Service confirms that you have authority to legally bind the business and that you are authorised to manage the business’ account with us.
Processing Your Order
After you submit your order, you will receive an email from us confirming the details of your order. Our acceptance of your order with this email brings into existence a legally binding contract between us on these terms. We will contact you by phone or email if there is a problem with delivery, or if we are unable to supply a product, for example if it is out of stock or no longer available. Your order will not be processed, nor will your credit or debit card be charged until items are in stock, and your order is dispatched. In the unlikely circumstance that you have already paid for the products, we will refund you the full amount as soon as reasonably possible.
We provide no guarantee as to the continued availability of any product and will not be liable to you should any product be out of stock or discontinued at any time.
Changing Your Order
If you wish to change your order, please contact us immediately. We will endeavour to make any changes that you require. However, this may not be possible if we have already started to process your order. You must confirm all changes in writing to us within a reasonable time and certainly within 24hrs of placing your order. Please be aware that any changes to an order may result in changes to the price and to the delivery timescale. We will inform you of these when you have made your changes.
The prices of the products will be as quoted on the website in British Pounds Sterling (GBP) and these include VAT at the applicable rate. All transactions will be processed in British Pounds Sterling (GBP). Your total order price will include the price of the product(s) including any applicable sales tax plus shipping charges.
All product prices, unless otherwise stated, exclude shipping costs which will be calculated at checkout and will be based on the delivery address and total weight of your order.
Prices quoted on our website may change at any time, but changes will not affect orders for which payment has already been received.
We will endeavour to deliver your purchases within a reasonable time from the date payment is received. Products will usually be dispatched the same day, on a working day, if your order is placed before 12.00 noon GMT, or the next working day if placed after 12.00 noon GMT, unless the product is temporarily out of stock. Once your order has been dispatched by us, delivery time is dependent on the nominated delivery method.
For our delivery options please see the Delivery page on this site. All delivery times quoted are estimates only, based on availability, normal processing and the performance of delivery companies. Any delivery service can be subject to delays, customs clearance, customs charges, or changes.
If an order is incorrectly addressed by us, then we will take full responsibility for the re-delivery, replacement of the product, or a refund. If you have provided an incorrect or incomplete address, then we will not refund or resend the product. In this case, the full cost of correcting the delivery will be held by you.
During the checkout process, we will ask you for your payment details. You can normally only pay for products using the debit or credit cards that we accept, as set out on the website. By completing your payment details, you confirm that the card being used is yours or if you are acting for a business, that you have the authority to use it. All card payments are subject to authorisation by your card issuer. Payment for products and all applicable shipping charges is made in advance. If you wish to pay by another means such as cheque or bank transfer, please ask for instructions by contacting us via the website.
Once your order is placed, it will be packaged at our warehouse and an email will be issued upon completion of the order. Tracking information (if applicable) will be supplied to you afterwards by the nominated courier.
You will become the owner of the goods you have ordered when the goods are dispatched to you from our warehouse.
Your order will be fulfilled within the time specified, unless there is a delay due to circumstances outside our control. Subject to your cancellation rights set out below, we will not be liable for any delay or failure to deliver the products due to such circumstances, including any failure in our next working day delivery service. However, we may refund you the difference between the cost of standard delivery and the guaranteed next-day delivery service.
If there is any delay, we will contact you with a revised estimated delivery date. We will try to deliver all of the products in one order together, unless you have requested otherwise, but we reserve the right to deliver your order in instalments, for example if there is a delay on a particular product. If you request us to deliver in instalments, then we may charge you extra delivery costs at our discretion. Delivery will be completed when we deliver the products to the delivery address that you specified. For home deliveries, if no one is available at the address to take delivery, the carrier for a tracked service will leave a card with further instructions.
We take all reasonable care to ensure that the products and their packaging leave our premises in good condition. If at the time of delivery to you, you find that the external packaging of the products is damaged and you suspect that the products are also likely to be damaged, you should not accept the delivery (if it is a tracked service) and should hand it to the courier to return it to us. If you do accept a delivery where the packaging is damaged, you must inform the courier in writing of the damaged packaging when you sign for the delivery, and take a photo of the damage prior to unwrapping the products. For non-tracked delivery services please contact us directly for further instructions.
Please inspect all products received at time of delivery. If you believe products have been damaged in transit, you must notify us within 48 hours of receipt of goods. If you do not notify us within this time, the products will be assumed to have been delivered in good condition, waiving any claims of any damage that may have occurred in transit.
If a product is deemed to be damaged or defective, we will replace it at no cost to you, providing appropriate notice is given.
If you are ordering goods for delivery outside of the European Union, you are responsible for customs clearance. Please note also that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that CWJ has no control over additional charges in relation to customs clearance. CWJ recommends that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your order.
Consumers have a legal right, through the Consumer Contract Regulations 2013, to cancel an order up to 14 days after the goods have been received. If the goods were received in instalments, this means 14 days after you receive your final instalment. Advice about your legal right to cancel your order is available from your local Citizens’ Advice Bureau or Trading Standards office. Your legal rights are not affected by these Terms of Service.
Your order may also be cancelled if an event outside of our reasonable control occurs, which affects our ability to supply products for at least 2 weeks, and in turn you decide you no longer want the product.
If you wish to cancel an order after it has been dispatched, we will refund the original purchase price and our standard delivery charge. This is provided that you have notified us within 14 days of receiving the products. Additionally, products should be unused, and returned in their original, undamaged packaging. Please note that we are permitted by law to retain sums to reflect any reduction in the value of the products if this has been caused by your handling them in a way which would not be permitted in a shop.
If the products which you are cancelling were delivered to you, you must return them to us no longer than 14 days after notifying us of the cancellation. If we agree to collect them, we will collect the products from the address to which they were delivered. We will contact you to arrange a suitable date for collection. Unless the products are faulty, incorrectly supplied, or not as described, you will be responsible for the cost of returning the products to us or, where relevant, the cost of us collecting them from you. If you are not in, or the goods are not available for collection on the agreed date of a collection, you are responsible for any additional collection costs that may be incurred. Refunds and Exchanges (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
Any refunds to you will be made to the debit or credit card account used for placing and paying for your order. Please allow up to 14 days for any refund to be processed and to reach your account. Please be aware that we reserve the right to withhold amounts for products which are damaged on return to us or where we have arranged for their collection.
We only replace items if they are defective or damaged. Please contact us for instructions on returning your product and where to send it. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
If you are shipping an item or items over £30 in value, you should consider using a trackable shipping service.
CWJ shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.
Updating of these Terms
Cook With Janie Limited may revise these Terms of Service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Service.
